When you become tax resident

How your foreign pension is treated

Spanish tax residents are taxed on worldwide income at progressive national plus regional rates. Foreign pensions are generally taxable in Spain. The U.S.-Spain treaty assigns taxing rights and the Foreign Tax Credit prevents true double taxation, but U.S. government pensions and Social Security are treated differently from private pensions, so the analysis is genuinely individual.

The U.S. tax treaty position

A U.S.-Spain income tax treaty is in force, substantially updated by a protocol effective in 2019. Read it, or have it read, before you move if you have meaningful assets.

Wealth tax

Yes. Spain levies a regional wealth tax on worldwide assets above a threshold, with allowances that vary sharply by autonomous community, plus a national solidarity tax on large fortunes designed to catch regions that had reduced their wealth tax to zero. For retirees with significant assets this is a first-order planning question and it is a genuine reason some choose Portugal or Italy instead.

Other taxes and reporting

Form 720 requires residents to declare foreign assets above 50,000 euros in each of three categories. Penalties for non-filing were reduced after a European Court of Justice ruling but the obligation remains. Inheritance and gift tax is regional and varies enormously; some regions are effectively free for close family, others are not.

The United States taxes its citizens on worldwide income wherever they live. Moving does not end your filing obligation, and FBAR reporting is triggered by an aggregate of 10,000 dollars across foreign accounts at any moment in the year.
