How Living in saudi arabia: getting a us document apostilled from abroad works, step by step

Saudi Arabia joined the Hague Apostille Convention on 7 December 2022, so a US document used there now needs an apostille — not consular legalization. Federal documents are apostilled by the US Department of State; state-issued documents by the Secretary of State of the issuing state. You can arrange both from Riyadh, Jeddah or Dhahran without flying home.

Does Saudi Arabia still require consular legalization?

No, and this is the single most important thing to get right. Saudi Arabia deposited its instrument of accession to the 1961 Convention on 8 April 2022, and the Convention entered into force for the Kingdom on 7 December 2022. Both the United States and Saudi Arabia are now Contracting Parties, which means a single apostille from the competent US authority replaces the old chain of Department of State authentication followed by Saudi embassy legalization.

The practical problem is that the internet has not caught up. A great deal of guidance still online — including HR checklists written for earlier hires and pages from services that never updated — describes the legalization route. Status was checked against the HCCH status table for this article; because accessions and objections can change, verify the current position yourself on the HCCH status table for the Apostille Convention before you file.

If your employer’s government relations office insists on “embassy legalization”, send them the HCCH entry-into-force date for Saudi Arabia and ask them to confirm in writing what they will accept. Do not pay for a legalization step that the treaty has removed — but equally, do not argue with the office that will process your iqama. Get their answer first, in writing, then buy the correct service once.

The same rule runs in the other direction. Documents issued inside Saudi Arabia are apostilled by the Saudi Ministry of Foreign Affairs, which operates apostille offices in Riyadh Province, the Western Province and the Eastern Province, and those documents no longer need US Embassy or Consulate authentication to be used in the United States.

Which US authority apostilles which document?

This fork decides everything, and it is where expatriate orders go wrong most often. The authority is determined by who signed or issued the document, not by where you live now and not by where your family lives.

  • Federal documents — an FBI Identity History Summary, IRS Form 6166 tax residency certificate, a Social Security benefit verification letter, a certificate of naturalization, a USCIS record — are apostilled only by the US Department of State, Office of Authentications in Washington, DC.
  • State and county documents — birth certificates, marriage certificates, divorce decrees, court orders, diplomas, and anything signed before a US notary — are apostilled by the Secretary of State of the state that issued or notarized it. A birth certificate from Ohio goes to Ohio. It cannot be apostilled in Texas because that is where you last had an address.
Who signed or issued your document? A US federal agency FBI, IRS, SSA, USCIS A US state, county or a US-commissioned notary A Saudi notary or other foreign official US Department of State Office of Authentications Secretary of State of the issuing state only No US apostille possible re-execute the document
The authority fork. Get this wrong and the package is returned unprocessed, with the transit time spent twice.

Which documents does a Saudi work visa and iqama file need?

There is no single public checklist that applies to every US national, every employer and every ministry. The document set is driven by your job category, your employer’s licence, and whether a spouse or children are joining you. Rather than pad this page with a list copied from an Indian or UK attestation route — which is not the same route — here is the honest instruction: get the checklist in writing from your employer’s government relations officer, and cross-check it with the Saudi Embassy or Consulate handling your visa issuance. Then apostille exactly what is on that list.

What follows is the set of US documents most commonly requested for employment and family files, with the authority that handles each. Use it to identify who you must order from and who apostilles it.

US documents commonly required for Saudi work and family files, and who apostilles each
Document Who issues it Federal or state Apostilled by Watch out for
FBI Identity History Summary (police clearance) FBI CJIS Division Federal US Department of State No Live Scan available to you abroad; card format errors
Birth certificate Vital records office of the state of birth State Secretary of State of that state Must be a certified copy from the custodian of record, not a notarized photocopy
Marriage certificate State or county where the marriage was recorded State Secretary of State of that state County-issued copies may need county clerk certification first
Divorce decree The court that granted it State Secretary of State of that state Needs the clerk of court’s certification, not just a case printout
Diploma or transcript The university or college registrar State (via notarization or registrar certification) Secretary of State of the institution’s state Degree verification by the Saudi employer or ministry may be a separate step
Certificate of naturalization USCIS Federal US Department of State It is a federal record — a state cannot touch it
IRS Form 6166 tax residency certificate Internal Revenue Service Federal US Department of State Must be requested from the IRS well before you need it
Social Security benefit verification letter Social Security Administration Federal US Department of State Downloaded copies are usually not acceptable for authentication
Power of attorney You, before a notary State (or consular) Secretary of State of the notary’s state A Saudi notary’s seal cannot be apostilled by any US state

How recent do the documents have to be?

Currency requirements are set by the receiving side, not by the US authority that issues the apostille. An apostille itself does not expire; the underlying document is what ages. In practice, police clearances, medical reports and civil status extracts are treated as short-lived by immigration and labour offices, while diplomas and naturalization certificates are not. No reliable universal figure exists for the Saudi work route, so anyone quoting you one flat number is guessing.

What you can control is the arithmetic. Ask your employer for the exact window they will accept, then work backwards from your immovable date — the medical, the visa stamping appointment, the Jawazat or Absher slot — and allow for four separate stretches of time: ordering the underlying document, the authority’s processing queue, international courier transit, and any translation done after arrival. The document’s age keeps running through every one of those. Requirements vary and the authority receiving your file has the final say on what it accepts.

Do I need an Arabic translation as well?

Assume yes. Saudi government and employer processes run in Arabic, and most files are submitted with an Arabic translation alongside the apostilled original. What is not uniform is who may produce it: some receiving entities require a translation office licensed inside the Kingdom, others accept a certified translation prepared in the US and attached to the document. Confirm this with the entity that will read the file before you commission anything.

One rule holds regardless: the apostille belongs on the US-issued original, not on the translation. We do not provide translation, and we will tell you plainly that a translation apostilled in place of the source document is a wasted certificate.

Why can’t I just use a notary here in Saudi Arabia?

Because a US Secretary of State can only certify the seal of a notary it commissioned. A Saudi notary — or any notary outside the United States — is outside that chain entirely, so no US state can apostille their seal. This is the most expensive mistake expatriates make: the document gets signed locally, couriered to a state capital, and returned unprocessed weeks later.

There are two workable routes for anything you must sign yourself, such as a power of attorney for a US property sale or a consent for a minor:

  • Sign before a notarizing consular officer at a US embassy or consulate in Saudi Arabia. A consular notarization is a US federal act and is not a state notarization, so confirm with both the embassy and the document’s recipient how the finished document should be certified for its intended use — the answer depends on whether the recipient is in the US or in the Kingdom.
  • Have the document executed in the United States by an agent you appoint, before a notary in the state where it will be used, then apostilled by that state’s Secretary of State.

The same logic explains the vital records rule: birth, death, marriage and divorce records and police clearances can only be certified by the custodian of record in the issuing jurisdiction. A notary’s stamp on a photocopy is not a certified copy, whatever the notary tells you.

How do I get an FBI background check without a Live Scan?

You cannot walk into a Live Scan site from Riyadh, and you do not need to. The FBI accepts Identity History Summary requests from applicants outside the United States, with fingerprint impressions taken abroad and submitted on a standard fingerprint card by mail, or submitted through an FBI-approved channeler. Check the current card format, submission method and mailing address on the FBI’s Identity History Summary Checks pages before you have prints taken — a card filled out in the wrong format, or prints taken by someone unfamiliar with the standard, is the usual reason a request is rejected and the whole cycle restarts. If you are comparing routes, our walkthrough on apostilling an FBI Identity History Summary for a visa file covers the federal side in detail.

What if I have no US address to send from or receive at?

Every US authority in this process communicates by post with a US address, and most will not courier internationally. Your options, in order of reliability:

  • A family member or friend who receives the document and forwards it under your written instruction — simplest, but it puts your originals in someone else’s hands and their diary.
  • A commercial mail-forwarding or virtual address provider in the state where you are ordering — useful for vital records, but check the provider will accept and forward government mail.
  • A document service that handles US-side receipt, filing and return shipping as part of the order, so the only leg you manage is the courier to and from Saudi Arabia. That is the model we operate, at $120 per apostille, all-inclusive — where the issuing agency or the authenticating authority charges a filing fee, it is already covered by that flat price. We are a private service and are not affiliated with the US Department of State, any US embassy or consulate, or any Saudi government body.

The general mechanics of running this from outside the country are set out in our guides to apostille services for Americans living abroad and apostilling a US document while you are not in the country. Gulf-specific logistics are close to identical across the region, so how the same process works for residents of the UAE is worth reading alongside this page.

Should I ship my original, or order a new one?

Order a new one wherever the document is a vital record. A fresh certified copy of a birth or marriage certificate can be ordered from the issuing state’s vital records office and delivered straight to your US-side handler — it never crosses a border twice, never clears customs, and never sits in a sorting facility in Jeddah. For most expatriate files, this is both faster and safer than shipping what you brought with you.

Ship only what cannot be re-issued, and treat those items differently. An original diploma, a certificate of naturalization, or a document you have already signed is genuinely difficult to replace from overseas; replacement means a government application filed from abroad with its own queue. When you must ship:

  • Use a tracked international courier, not ordinary post, in both directions.
  • Declare the contents honestly as documents of no commercial value; an inflated declared value invites a customs hold.
  • Scan every page before it leaves your hands, front and back, including any existing seals.
  • Expect customs inspection on the return leg into the Kingdom and build slack for it.

Nobody can guarantee an international delivery date — courier networks, customs inspection and public holidays on two continents are outside any service’s control. Treat any promised door-to-door date as marketing.

Common reasons an apostille request is rejected

  • Sent to the wrong state. The document went to the state you live in or last lived in, rather than the state that issued it.
  • A foreign notary’s seal. Signed before a notary in Saudi Arabia, which no US state can certify.
  • A notarized photocopy instead of a certified copy. Vital records must come from the custodian of record.
  • A federal document sent to a state, or a state document sent to the Department of State. Each authority returns what is not its own.
  • Extra certification layers added to a federal document. A federal apostille certifies the issuing official’s signature; adding a notary on top does not help and can cause the package to be returned. Confirm submission requirements before you add anything.
  • The destination country is missing from the request. The Department of State’s authentication request form must identify where the document is going — the form is currently designated DS-4194, and you should confirm the current version and mailing address on travel.state.gov before you file.
  • Signature not on file. The official who signed the record is not on record with the certifying authority, common with older court and university documents.
  • Laminated, torn or altered documents. Lamination in particular is treated as tampering by several state offices.
  • Name mismatch across the file. A maiden name on the birth certificate and a married name on the passport, with no marriage certificate in the set to bridge them.
  • Apostille placed on the translation. Certified but useless — the certificate has to sit on the US-issued original.
  • The document aged out in transit. It met the employer’s currency window when you posted it and did not when it arrived.

What order should I do this in?

Sequence matters more than speed here. Reversing steps two and three — apostilling before you know what the employer wants — is the most common way expatriates pay twice.

  1. Get the checklist in writing. Ask your employer’s government relations officer, and the Saudi mission handling your visa, exactly which documents they need, how recent they must be, and whether they accept an apostille rather than legalization now that the Convention is in force.
  2. Fix your immovable date and count backwards. Identify the appointment you cannot move, then allocate time for ordering, processing, transit and translation — in that order, with slack at each stage.
  3. Order the underlying documents. Certified copies from the relevant state vital records office or court clerk; federal records direct from the FBI, IRS, SSA or USCIS. Have them delivered to your US-side handler, not to Saudi Arabia.
  4. Route each document to the correct authority. Federal records to the US Department of State; state records to the Secretary of State of the issuing state. One package per authority.
  5. Courier the apostilled originals to the Kingdom. Tracked, both ways, with scans retained.
  6. Arrange Arabic translation on the terms the recipient requires, then submit the complete file for your visa or iqama.

Your next step

Pull up your employer’s document list today and mark each item F or S — federal or state. That single pass tells you which authority each document is going to, and it will usually reveal one document that is in the wrong column or one certified copy you do not actually hold. Once the list is sorted, you can start an order for the documents you already have in hand and order the missing certified copies at the same time, so nothing waits on anything else. Verify Saudi Arabia’s current status on the HCCH table and your processing expectations on travel.state.gov before you commit to a date.

Frequently asked questions

Does Saudi Arabia accept apostilles, or does it still require consular legalization?

Saudi Arabia acceded to the 1961 Hague Apostille Convention on 8 April 2022, and the Convention entered into force for Saudi Arabia on 7 December 2022. A US public document destined for Saudi Arabia therefore needs an apostille from the competent US authority, not embassy legalization. Guidance published before December 2022 still describes the old legalization chain and is out of date; if your employer's HR file was written earlier, ask them to confirm they will accept an apostilled document.

Which US authority apostilles my document?

It depends entirely on who issued or signed it. Documents issued by a federal agency — an FBI Identity History Summary, IRS Form 6166, a Social Security benefit verification letter, a certificate of naturalization — are apostilled only by the US Department of State's Office of Authentications. Documents issued by a state or county, or signed before a US notary, are apostilled by the Secretary of State of that specific state. It is the state that issued the record, not the state you last lived in.

Can I sign a power of attorney in front of a notary in Saudi Arabia and have it apostilled in the US?

No. A US state can only apostille the seal of a notary commissioned by that state, so a Saudi notary's seal cannot receive a US apostille. Your options are to sign before a notarizing consular officer at a US embassy or consulate in Saudi Arabia, or to have the document executed in the US by someone acting for you. Ask the Saudi entity receiving the document which form it will accept before you pay for anything.

How recent does a document have to be for a Saudi work visa or iqama file?

There is no single published age limit that applies to every US document and every Saudi employer. Police clearances, medical reports and civil status records are commonly treated as short-lived, while diplomas and naturalization certificates are not. Get the currency requirement in writing from your employer's government relations officer or the Saudi Embassy handling your visa, then count backwards from your appointment date — the clock keeps running while the envelope is in transit.

Do I need an Arabic translation as well as an apostille?

Saudi authorities generally work in Arabic, and most employers expect an Arabic translation alongside the apostilled original. Requirements differ on who may translate and whether the translation must be produced by an approved office inside Saudi Arabia, so confirm this with the receiving entity rather than assuming. Never let anyone apostille the translation instead of the original document — the apostille belongs on the US-issued record.

How do I get an FBI background check if I cannot do a Live Scan in the United States?

The FBI accepts identity history requests submitted from outside the US, and fingerprint impressions can be taken abroad and mailed in on a standard fingerprint card, or submitted through an FBI-approved channeler. Check the current options, card format and mailing address on the FBI's Identity History Summary Checks pages before you have prints taken, because a card completed in the wrong format is the most common cause of a rejected submission.

What does your service cost, and is the government fee extra?

Our price is $120 per apostille, all-inclusive — no separate government-fee surcharge and no per-page add-ons. Where the issuing agency or the authenticating authority charges a filing fee, that is already covered by our flat price. We are a private document service and are not affiliated with the US Department of State, any US embassy or consulate, or any Saudi government body.

What if my original document is lost in the post?

Certified copies of birth, marriage and death records can be re-ordered from the issuing state's vital records office, so they are replaceable with time and cost. A certificate of naturalization, an original diploma or a signed original power of attorney are far harder or slower to replace. Send replaceable certified copies rather than the only original you hold, use a tracked courier in both directions, and keep scans of everything before it leaves your hands.
