New York Apostille for China — No Consulate Step Since 2023

China joined the Hague Apostille Convention in November 2023, and it changed this process more than any development in a decade. The old route — notarization, county clerk, state, U.S. Department of State, then the Chinese consulate — collapsed into a single apostille. A great deal of guidance still online describes the abolished process.

What changed

Before the Convention entered into force for China, a New York document needed consular legalization at the Chinese Embassy or a consulate after federal authentication. That step is gone for documents going to mainland China. A New York apostille from the Department of State now stands on its own.

If an employer, university or agency has handed you instructions mentioning consular legalization or the Chinese Consulate General in New York, check the date on them. We still see 2019-era checklists circulating in HR departments.

Hong Kong and Macau were already covered under the Convention before the mainland joined, through their own arrangements. Taiwan is not a party — documents for Taiwan still require legalization through the Taipei Economic and Cultural Office, and we handle that route separately.

What New York sends to China

Work permits and Z visas are the dominant category, which means transcript or diploma records, a DCJS background check certificate, and often a notarized employment or degree verification. Note that Chinese employers frequently require the FBI check rather than the DCJS one — that is a federal document, authenticated in Washington rather than Albany, and we file both in one order when the employer asks for either.

Marriage registration and family matters need marriage certificate and birth certificate records. Business and property matters run on an apostilled power of attorney. Adoption files carry all of the above.

Translation

A Chinese translation is generally required, and receiving bodies in China commonly expect it to be produced by a translation agency recognised there, with the agency’s seal. Requirements differ between provinces and between employers and government bureaus, so ask the entity that will receive the document before commissioning anything.

Timing

Work permit files run on tight deadlines and background checks expire quickly. The New York apostille is same-day when filed in person; the constraint is DCJS or FBI processing upstream and the translation downstream. Plan backwards from the visa appointment.

How we handle it

  1. Tell us the document and what the consulate or receiving authority asked for. We identify the certification chain before anything is ordered.
  2. We obtain certified copies where needed, arrange notarization, and confirm which County Clerk the document has to pass through.
  3. We file at the New York Department of State counter in person rather than posting it into the queue.
  4. Certified translation runs in parallel, to the standard the destination actually accepts.
  5. The finished set is couriered to you, or directly to your lawyer or representative abroad.
Does China still require consular legalization?

Not for mainland China. China joined the Hague Apostille Convention in November 2023, so a New York apostille is now sufficient on its own. Instructions describing consular legalization predate that change.

What about Taiwan?

Taiwan is not a party to the Convention. Documents for Taiwan still require legalization through the Taipei Economic and Cultural Office, which is a different process that we handle separately.

My employer wants an FBI check, not a New York one.

That is common for work permits. An FBI Identity History Summary is a federal document authenticated by the U.S. Department of State in Washington, not by New York. We file both in one order when needed.

Who should translate the documents into Chinese?

Receiving bodies in China commonly expect a translation agency recognised there, with its seal. Requirements vary by province and by employer, so confirm with the entity receiving the document.

How fast can this be done?

The New York apostille is same-day at the counter once the certification chain is complete. The real constraints are background check processing upstream and translation downstream.
